[Opinion] 蘋果獲得終極智能手機觸控界面專利??




那天看到幾則新聞報導,讓我著實嚇了一跳:

我想,該不會是Apple有了甚麼前瞻性、突破性的大發明了吧!?
點進去看了一下,大失所望。
原來又是"標題殺人法"



依我的觀點:

Apple新獲准(2012/7/17獲准)的這件專利“Portable electronic device, method, and graphical user interface for displaying electronic lists and documents” (專利號:US 8,223,134),實際上是2008/1/4所提出之8,130,205專利案之延續案(Continuation of application)。為的是補主張先前所沒claim到的技術特徵。
此外,這篇專利還主張了一堆美國臨時案,其最早可以追朔到2007/1/7。



8223134 這篇專利雖然內容非常多,整份長達108頁涵蓋各種實施態樣(大部分的頁數應該是Apple的"灌水性專利通用頁面"),但審查過程中,經過了兩次核駁,也被要求限縮範圍。目前claim中剩下的保護重點,僅僅在於: “圖像側邊的垂直軸圖像”


















如上圖所示,垂直軸圖像的長度,可隨著表單超出螢幕部分的長度而改變。垂直軸圖像只是用來展示比例,而並非供使用者按壓捲動。當表單超出螢幕的部分增長時,垂直軸圖像隨之縮小。以便於呈現目前閱覽部分占表單整體的比例。
說明書中相關敘述包括:

In some embodiments, vertical bar 516 is displayed temporarily after an
object is detected on or near the touch screen display (e.g., a finger touch
is detected anywhere on the list of instant message conversations). In some
embodiments, the vertical bar 516 has a vertical position on top of the
displayed portion of the list that corresponds to the vertical position in
the list of the displayed portion of the list. In some embodiments, the
vertical bar 516 has a vertical length that corresponds to the portion of
the list being displayed. In some embodiments, if the entire list of IM
conversations can be displayed simultaneously on the touch screen 112, the
vertical bar 516 is not displayed. In some embodiments, if the entire list
of IM conversations can be displayed simultaneously on the touch screen 112,
the vertical bar 516 is displayed with a length that corresponds to the
length of the list display area (e.g., as shown in FIG. 5).



In some embodiments, vertical bar 630 is displayed temporarily after an
object is detected on or near the touch screen display (e.g., a finger touch
is detected anywhere on the list of instant messages). In some embodiments,
the vertical bar 630 has a vertical position on top of the displayed portion
of the list that corresponds to the vertical position in the list of the
displayed portion of the list. In some embodiments, the vertical bar 630 has
a vertical length that corresponds to the portion of the list being
displayed. For example, in FIG. 6A, the vertical position of the vertical
bar 630 indicates that the bottom of the list of messages is being displayed
(which correspond to the most recent messages) and the vertical length of
the vertical bar 630 indicates that roughly half of the messages in the
conversation are being displayed.




主要申請專利範圍為:

1. A method, comprising: at a portable multifunction device with a
touch screen display: displaying a portion of an electronic document on the
touch screen display, wherein the displayed portion of the electronic
document has a vertical position in the electronic document; displaying a
vertical bar on top of the displayed portion of the electronic document, the
vertical bar displayed proximate to a vertical edge of the displayed portion
of the electronic document, wherein: the vertical bar has a vertical
position on top of the displayed portion of the electronic document that
corresponds to the vertical position in the electronic document of the
displayed portion of the electronic document; and the vertical bar is not a
scroll bar; detecting a movement of an object in a direction on the
displayed portion of the electronic document; in response to detecting the
movement: scrolling the electronic document displayed on the touch screen
display in the direction of movement of the object so that a new portion of
the electronic document is displayed, moving the vertical bar to a new
vertical position such that the new vertical position corresponds to the
vertical position in the electronic document of the displayed new portion of
the electronic document, and maintaining the vertical bar proximate to the
vertical edge of the displayed portion of the electronic document; and in
response to a predetermined condition being met, ceasing to display the
vertical bar while continuing to display the displayed portion of the
electronic document, wherein the displayed portion of the electronic
document has a vertical extent that is less than a vertical extent of the
electronic document.



上面的Claim中,限制性敘述" and the vertical bar is not a scroll bar"是在審查過程中,為了避開審查委員所引用的前案而做的限縮。其強調了vertical bar並不是用來捲動的,以與其他前案中可捲動的方式相區隔。
然而,這樣的限縮,也同時造成禁反言的效果。
也就是說,日後,Apple欲對競爭對手主張這篇專利時,得先看看對手產品上的vertical bar,是不是scroll bar? 如果對手產品上的是具有捲動功能的bar,那麼,就不容易符合全要件原則而落入其專利範圍了。



由上述可知,實際上這件專利所能涵蓋的範圍非常有限,充其量包括“各種用來展示比例的軸圖像”,加上由於其在答辯時,已將範圍限死在於"不提供捲動功能",因此主張上相對不易,並非像媒體所聲稱般的具有強大威力。就迴避面上,應該是不難,只要使用最傳統的“固定長度式卷軸”,即可迴避。而這也不算是新技術,早在Iphone 3GS產品上,就已看得到這樣特徵。



在資訊爆炸的時代中,"收集並判斷資訊"是非常重要的。尤其現在專利戰爭火熱發展,每天都有熱烘烘強強滾的專利新聞、分析報導。有的是添油加醋、爆炸聳動,語不驚人死不休。讓讀者邊讀邊罵,而且還是咬著牙的罵。
----這樣的報導,將陷公眾於無知之中。

身為讀者的我們,在獲取這類資訊了之後,最重要的是求真、求實,與其盡信,不如不信。

一但對於專利的內涵有了深一層的了解之後,你將可以發現:
專利,其實非常簡單,但又不那麼簡單。

[Opinion] FACEBOOK風華背後的憂愁







「利益之所在,兵爭之所在」,不分人地,自古皆然。
或許僅有的差別只在於兵爭之手段:從石塊到木棒,從木棒到槍,再從槍到金錢,最後,從金錢演化成專利。

富蘭克林說:「專利是淋澆在天才之火上的利益之油」,只是,近幾年的專利訴訟打下來,我們逐漸了解一件事:當利益之油過於肥沃充盈,則在微弱閃爍的天才之火之外,更將伴隨燃起一把熊熊的人類貪婪巨火

打從2010年facebook以怵然突起之姿,崛起於網路界後,傳統的網路巨頭們紛紛中箭落馬,從舞台的聚光燈中狼狽退場。有的早已銷聲匿跡,有的則臥薪嘗膽歛聚力量,意圖東山再起。

Yahoo,這個曾經風光一時的網路雄主,就是此刻在舞台邊緣糾結憤恨卻又風華不再的舞者,他以滿腔咒怨的眼光瞪視著舞台中央舞姿翩翩,吸引眾人趨慕的facebook,一位市場寵愛集一身的妖豔舞姬。她憤恨,看到facebook 上市時的風光,讓她回想起之前繁華似錦的年華,不由得妒火中燒。在殘火餘燼的明暗火光中,他暗暗在心中定下了復仇計畫,決心把她多年來所累積的力量,一次爆發,在專利的戰場上,將facebook推落痛苦的深淵。


於是,2012年3月12日,Yahoo向北加州地方法院遞出了狀紙,控訴Facebook侵害其十項專利,分別是:

US Patent 7454509 Online Playback system with community bias(這件專利是關於 “讓你與朋友之間可以分享 
        所喜歡音樂的音樂共享中心”)

US Patent 7599935 Control for enabling a user to preview display of selected content based on another user’s 
        authorization level (這件專利是關於Facebook的“Feed”功能,朋友之間可以看到彼此所希望分享的內容)

US Patent 5983227 Dynamic Page Generator(這件專利大概是關於 “使用者自訂喜愛頁面風格”)

US Patent 7747648 World Modeling using a relationship network with communication channels to entities.(這件
       專利是關於 “使用者在所使用的社交網路中發送私人訊息之系統”)

US Patent 7406501 System and method for instant messaging using an e-mail protocol
         (這件專利是關於“在所使用的社交網路中使用即時通訊”)

US Patent 6907566, US Patent 7100111, and US Patent 7373599 Method and system for optimum placement of 
        advertisements on a webpage(這幾件專利是關於 “依據使用者習慣以及興趣在網站上設置不同廣告”)

US Patent 7668861 System and method to determine the validity of an interaction on a networking
        (這件專利是關於 “利用使用者所張貼的資訊來判斷使用者是否為真人的系統”)

US Patent 7269590 Method and system for customizing views of information associated with a social network user.
        (這件專利是關於“依據不同使用者的不同登入紀錄來決定登入時所呈現的不同頁面資訊”)

Facebook隨即發表了聲明:


We’re disappointed that Yahoo’s effort to engage with us was limited to a few short     phone calls and that we continue to learn of new developments about a long-time partner through the press. We will defend ourselves vigorously against these puzzling actions.

並且立即以本身所擁有的十項社交網路相關專利反擊。


在這些專利之中,最知名的算是 7,669,123 “a news feed in a social network environment,”這一篇了。這篇專利記載了Facebook眾所周知的NewsFeed(動態消息)模式。目前,這一件專利被匿名人士提出Reexmination(類似台灣的舉發、大陸的無效程序 ),而Yahoo否認是他幹的。



2012年美東時間5/18日早晨十一點,Facebook在那斯達克市場以「FB」代號風光掛牌上市。在投資人熱烈認購下,這樁世紀IPO一舉集資160億美元,締造科技業新猷。臉書上市招股價訂在38美元,市值達1042億美元,躍居史上IPO身價最高的公司之一。

創辦人祖克伯在數百位員工簇擁下,於加州門羅公園市總部舉行的跨日「駭客爽」(hackathon)大會,遙控主持敲開盤鐘儀式,宣告臉書上市。開盤後,臉書股價立刻上漲11%,來到42.18美元;而且短短30秒內,交易量就高達八千兩百萬股。就美國市場而言,這次籌資金額僅次於2008年Visa的一百九十七億美元,高於2010年通用汽車的一百五十七億七千萬美元。

然而好景不常...

Facebook在上市後不久,開始一路下跌,投資人被套牢,市場也開始猜疑其是否符合原先預期的價值。直到今天回穩到31美元。以此價格計算,臉書以每股38美元上市後,市值已蒸發190多億美元。2012/5/22 美國2大最高金融主管機關今天說,臉書首度公開募股衍生出來的問題應該要調查,這讓臉書、主要承銷商摩根士丹利及那斯達克股票市場(Nasdaq)面臨新的壓力。

    繁華落盡之後,Facebook褪去亮麗的妝彩,陷入深深的愁思。


近幾年,Facebook已經遭遇了30多起專利訴訟,僅在提出IPO申請前後,Facebook就捲入了5件專利訴訟之中:三個來自於非實體企業,一個來自於Mitel,另一個則來自於雅虎。

 望眼目前的各大科技巨頭:Microsoft、Google、Apple、IBM、Intel…,無一不是有幾千幾萬件專利傍身,且每年的專利申請量與年俱增,各自建構出深長的專利戰壕。更重要的是,他們的專利涵蓋的面向之廣,從軟體到硬體、從國內到國外、從舊技術到新技術、從電子到機構到半導體製程…,層面之廣,叫人驚嘆。且不論其中有幾件是真正具有攻擊性的專利,光是看到他們的專利數量,就足以叫人不敢輕舉妄動。

如在資料和檔管理、資訊存儲方面,Google創建了一些資料庫並公佈了其在資料庫領域取得的部分成果,包括Facebook在內的很多公司都使用了這些資訊來創建自己的資料中心,而Google的很多專利都與關鍵的資料創新中心有關。

甲骨文、IBM和Microsoft等老牌企業,也花費了數十年時間申請了大量與檔管理和資訊存儲相關的技術專利,Facebook對這些技術相關的開源軟體的免費使用同樣存在著風險。一旦老牌企業決定對Facebook使用這些專利武器,Facebook將面臨巨大挑戰。

Facebook以後起之秀之姿,林列於這些科技巨頭之間,雖然彼此有各自的領域,平常也井水不犯河水,但是,這些專利所建構出的壁壘,實際上已成為令facebook坐困愁城的圍牆。種種跡象顯示,Facebook在現有的領域中,面臨了專利軍備不足以及專利申請能量不足的困擾:

美國專利和商標局公佈的資料顯示,截至2011年12月,Facebook僅擁有56項授權專利和503項正在申請的專利,並且73%的專利申請是在近18個月內提出的。另外,在已授權的56項專利中,有39項是Facebook通過收購所得。另外,Facebook還花了$550 Million向Microsoft購買AOL的專利。


換句話說,自2004年創立至今,Facebook自己所擁有的專利寥寥無幾,目前的專利防衛,都是近來砸大錢買來的。

在專利軍備遠水救不了近火之下,Facebook成為了一些為了提高知名度的中小企業或者趁火打劫的專利流氓們最佳的攻擊靶子。


而除了上面的問題之外,Facebook還面臨著另外一個問題:創新客體有限
 

身為網路社群經營產業的巨擘,Facebook理所當然的把其核心技術定位在網路社交的軟體介面上,例如近來所獲得的New Feed、Visual tags等專利。然而,Facebook的創新大部分僅限於網路技術方法,而非如同Apple、Google等可以橫跨軟硬體。

而非實體的軟體方法專利,一直以來備受爭議,尤其在Bilski判決再次強調了machine-or-transformation測試法(Claimed process is patent eligible if: (1) it is tied to a particular machine or apparatus, or (2) it transforms a particular article into a different state or thing)之後,想要申請單純軟體方法專利,更是難上加難。


          從最近Facebook所獲准的專利大都與"裝置"(Device)或"系統"(System)有關,可以對其所面臨的困境略窺一二:

如果Facebook想要增加專利獲准量,為今之計,只能把研究範圍延伸到實體裝置的領域。然而實體裝置領域原非Facebook之所長,且各大廠各自佔據山頭為王,更是讓Facebook面臨困獸之鬥的窘境。

但這一步不得不走...

Facebook如果死守在網路社交平台這邊發展智財,無疑是枯守在一片不易攫取水源的沙漠中,生存之道,只有把研發方向延伸到硬體裝置上。而我相信,不久之後,我們可以在Facebook的新專利中看到所透露出來的這樣訊息。

後記

從最近Facebook所申請的專利可以發現,其已經不再申請單純申請網路社群相關專利了,而是慢慢把申請客體延伸到"裝置、系統"相關的專利上了。
未來這些裝置、系統專利獲准後,Facebook要如何運用,值得觀察。




在前幾天的報導中,也看到了這樣的一則新聞:
"招攬蘋果前員工 Facebook又想開發新手機?"

看起來,Facebook已經查覺到固守網路社群非長久之策,並且已經開始蠢蠢欲動了....

而在Facebook宣布跨入硬體領域之後
血腥殘酷的專利割喉戰,將就此展開...

[Litigation] Apple vs Motorola,血戰德國!!







        德國,這個二次大戰中的戰役軸心與殺戮戰場,在戰爭結束後隨著煙硝散去,逐漸恢復了平靜。

        但在德國的法院,專利上的交戰卻砲火四射,越演越烈。


        憑藉著久遠歷史下發展出來的深厚法律體系根基,德國長久以來一直是陸系法律的發源地及學術殿堂。

        而由於德國審判程序快速、禁制效果強大,並操縱著歐盟市場的輸入樞紐,因此德國成為了除了美國之外各方交火的兵家必爭之地,自去年開始,訴訟案量激增。

        自從今年(2012)以來,在此交戰最為激烈的,莫過於Apple Android陣營中的重裝傭兵---Motorola了。

        兩個禮拜前(2012/02/16),慕尼黑地方法院曾獲准Apple一個禁制令,這個禁制令是針對涉及「滑動解鎖」(Slide to unlock EP1964022號專利)技術的Motorola行動裝置。然而,這項禁制令美中不足的是,它並未涵蓋到Motorola的主力產品,也是iPad的強敵--Xoom tablet



當然,Motorola也不是好惹的。

Motorola以其所擁有的兩項基礎規格(essential standard)相關專利向Apple提出訴訟,獲得了勝利而在德國也取得了禁制令,使得Apple面臨了巨大的威脅。但是,2012/2/27卡路斯高等法院(Karlsruhe Higher Regional Court)在基於競爭法、FRAND(註)規定的考量,對Motorola發出了first temporary suspension of the enforcement,使得Motorola無法執行其贏得的禁制令。但是,同時Apple被賦以義務須向Motorola支付合理的權利金。

註:FRAND指的是:標準制定組織中,若有成員擁有涉及到標準的基礎規格相關專利,則該成員必須基於合理和非歧視性的條款RAND)或公平、合理、非歧視性的條款FRAND)的標準,對相關業者(不限定組織成員)進行授權。FRANDRAND這兩個術語通常可以互換FRAND在歐洲比較常用,而RAND則在美國比較常用)
標準制定組織把這項義務規定制定在其章程中,作為一種手段去提高其產業競爭。意圖去防止成員們,在獲得涵蓋產業標準的專利權後,以壟斷性手段壓迫其他競爭對手。一旦組織認為某件專利涉及到基礎的規格,就會核發一個FRAND認證,然後擁有該項專利權的成員必須同意組織內外的成員提出專利授權要求。
藉由如此規定,可以去約束而避免標準制定組織成員們強加不公平、不合理且有差異性的專利授權條件於競爭對手身上,因而影響到產業的良性競爭且獲取不正當利益。


而就在四天前(2012/03/01)德國慕尼黑一級地方法院( Munich I Regional Court主審法官Dr. Peter Guntz宣布,Apple再度贏得了一個對摩托羅拉移動技術公司(Motorola Mobility Inc, 以下稱Motorola)的禁制令,這項禁制令包括了所有涉及「photo gallery」專利的行動裝置。

photo gallery」專利,泛指的是EP 2059868。其實,Apple不是第一次用EP 2059868專利來告人。早在去年(2011)6月,Apple向荷蘭法院提起訴訟,主張Samsung智慧手機和平板電腦共侵犯了蘋果的3項技術專利及1項外觀設計專利,其中的一篇技術專利,便是EP 2059868。並且,成功的獲得了Samsung的侵權判決。
但可惜的是,這項侵權判決的效果有限,並不能影響到Samsung的主要產品Galaxy Tab 10.1. (參看)。


        什麼是「photo gallery」技術?
        讓我們來看看Apple此次獲得勝利所依仗的專利:

看起來非常長非常複雜,但簡而言之就是:

Motorola如何侵權了?
看這個影片,對照一下上面圖片或手邊的iPhone你應該可以瞭解了:





影片中,清清楚楚顯示了Motorola XT701智慧型手機「往側邊拉照片時,沒超過一半放開手指,就會自動彈回;往側邊拉照片超過一定幅度,圖片就會自動彈走切換」



如果Apple真的實施該禁制令,則可能有望要求德國境內的Motorola零售商將所有侵權產品下架,從而進行銷毀。


但在現實的考量下,Motorola絕不可能從德國市場撤出,較有可能的做法,是對其行動裝置產品的操作軟體進行「迴避設計(work around)」。


究竟Motorola將如何修改他們的圖片展示模式,目前還不得而知。
但迫使競爭對手去進行迴避設計修剪掉原本好用的功能,就像當初三星一樣,或許正是賈伯斯的所想要的。
